Florida is a “no-fault” state when it comes to divorce. This means that Florida courts do not blame or punish either party for causing or seeking a divorce. Under most circumstances, Florida courts will not consider factors like extramarital affairs or other such bad behavior in deciding whether to grant a divorce. There are essentially only two requirements for divorce in Florida: at least one of the parties must be a resident of Florida for six months prior to filing; and the marriage must be irretrievably broken. It is the policy of the State of Florida to encourage married couples to stay together and to offer parties every opportunity to safe a marriage. Either spouse can file for a divorce, and the court does not favor the Petitioner.

There are two main types of divorce in Florida: divorces may be contested or uncontested. An uncontested divorce is one in which both parties agree as to all of the issues in the divorce. The specific issues in each divorce depend on the parties. Uncontested divorces are generally less stressful for everyone involved and faster than a contested divorce. Uncontested divorces allow spouses to make important decisions about their family without ever going to court.
