A divorce, also known as a dissolution of marriage, may be sought in two ways under Florida law. The more common form is known as a “regular dissolution of marriage,” while the other form is known as a “simplified dissolution of marriage.”

A regular dissolution of marriage may be contested or uncontested. A contested divorce is one in which the parties cannot agree on a number of major issues, such as property division, child custody, or others. In these situations, a judge will examine the overall situation and circumstances of the spouses and make a final determination about each issue. An uncontested divorce, on the other hand, is one in which both spouses agree about issues regarding marital property, debt, and minor children. In either case, we always seek to resolve our clients’ matters through a low-cost divorce whenever possible.

In a simplified divorce, the spouses must not have any minor children from the marriage, the wife must not be pregnant at the time of filing for the divorce, and both spouses must attend the final divorce hearing.

For either type of divorce, one spouse must have lived in Florida for six months prior to filing for divorce. Florida is a “no fault” state, which means that neither party is required to prove that their spouse was at fault for causing the divorce. Instead, it is sufficient that the marriage is “irretrievably broken.” The court does not require any corroborating evidence to prove that a marriage is irretrievably broken.
